Welcome to Hot Metal Transfers, LLC, a Pennsylvania limited liability company (“Company,” “we,” “us,” or “our”). By accessing or using our website, www.hotmetaltransfers.com (the “Site”), and purchasing firearms, ammunition, or accessories, you (“Customer,” “you,” or “your”) agree to these Terms & Conditions. Please read carefully before making a purchase.

1. Use of Website

  • Account Creation: You may be required to create an account to purchase products. You agree to provide accurate and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
  • Privacy Notice: By creating an account, you consent to the collection and use of your personal information as described in our Privacy Policy.
  • Prohibited Conduct: You agree not to:
    • Use the Site for unlawful purposes.
    • Attempt to gain unauthorized access to our systems.
    • Misrepresent your identity or eligibility to purchase firearms or accessories.
    • Upload or transmit harmful code, malware, or disruptive content.
  • Intellectual Property: All content on the Site, including text, images, logos, product descriptions, and software, is the property of Hot Metal Transfers, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
  • Termination of Access: We reserve the right to suspend or terminate your access to the Site at any time, without notice, for violation of these Terms or applicable law.

2. Eligibility to Purchase

  • You must be at least 18 years old to purchase rifles, shotguns, or certain firearms accessories, and 21 years old to purchase handguns, frames/receivers, or other restricted items, unless otherwise permitted by law.
  • You represent and warrant that you are not prohibited from owning or purchasing firearms under federal, state, or local law.
  • By placing an order, you certify that all information provided is true, complete, and accurate.
  • Data Collection: Information you provide for purchases (e.g., name, address, date of birth) will be collected and used in accordance with our Privacy Policy.

3. Firearms Purchases & Transfers

  • Federal Firearms License (FFL): All firearms must be shipped to and transferred through a licensed FFL dealer in your state of residence.
  • Background Check: You are responsible for completing ATF Form 4473 and passing the National Instant Criminal Background Check System (NICS) check at your chosen FFL.
  • Compliance: We reserve the right to cancel any order if you fail to comply with federal, state, or local firearm laws.
  • Transfer Fees: Any FFL transfer fees are the responsibility of the buyer.
  • Data Use: Information required for firearms transactions will be handled according to our Privacy Policy and disclosed only as necessary for legal compliance.

4. Ammunition Purchases

  • You must be of legal age under federal and state law to purchase ammunition.
  • Some states and municipalities have additional restrictions on ammunition sales. It is your responsibility to know and comply with these laws.
  • Ammunition must ship via Ground Shipping.  We will not ship ammunition to: Alaska, California, Connecticut, Hawaii, Illinois, Massachusetts, New Jersey, New York, or Washington, DC.

5. Shipping & Delivery

  • Firearms will only be shipped to valid FFL holders. Non-firearm items may be shipped directly to the customer where legally permitted.
  • We do not ship firearms, ammunition, or accessories to jurisdictions where prohibited by law (see Section 12: State & Local Restrictions).
  • Customers are responsible for providing accurate shipping and FFL information. Delays caused by incorrect or incomplete information are not our responsibility.

6. Returns & Cancellations

  • Firearms: Once a firearm is transferred to you by the FFL, it cannot be returned. All firearm sales are final.
  • Accessories & Non-Firearm Items: Returns may be accepted within three (3) days of delivery, subject to inspection and approval. Items must be unused and in original packaging.
  • Order Cancellations: Cancellations before shipment may be subject to a 15% restocking fee. If a firearm is denied at transfer (failed background check), a restocking fee will apply, and shipping costs are non-refundable.

7. Legal Compliance

  • You are solely responsible for knowing and complying with all federal, state, and local laws governing the purchase, possession, and use of firearms, ammunition, and accessories.
  • We make no guarantee that any product is legal in your jurisdiction. Orders placed in violation of applicable laws will be cancelled.

8. 4473 Disclaimer

Completion of ATF Form 4473 and related background checks is required for all firearm transfers. By purchasing a firearm through our Site, you acknowledge and agree that your personal information may be disclosed to an FFL dealer, the ATF, or law enforcement for compliance, inspection, or investigative purposes.
 

9. Waiver of Liability / Assumption of Risk

By purchasing firearms, ammunition, or related products from Hot Metal Transfers, LLC, you acknowledge and agree to the following:

  • Firearms and ammunition are inherently dangerous products.
  • You assume all risks of ownership, handling, storage, use, and misuse of the products purchased, including the risk of serious personal injury or death.
  • You are solely responsible for ensuring that products are used in a safe and lawful manner and by individuals legally permitted to use them.
  • You release and hold harmless Hot Metal Transfers, LLC, its owners, employees, and affiliates from any and all liability, claims, or damages arising out of or related to your purchase, possession, or use of any product sold.

10. Limitation of Liability

  • To the fullest extent permitted by law, Hot Metal Transfers, LLC disclaims all liability for damages, injuries, or losses arising from misuse, unlawful use, or negligence related to any product purchased.
  • Our maximum liability, if any, shall be limited to the amount you paid for the product giving rise to the claim.

11. Warranties

  • Manufacturer warranties, if applicable, apply to the products sold. We make no independent warranties, express or implied, including merchantability or fitness for a particular purpose.

12. Indemnification

You agree to indemnify, defend, and hold harmless Hot Metal Transfers, LLC, its owners, employees, and affiliates from any claims, damages, or expenses arising from your violation of these Terms, your unlawful conduct, or misuse of products purchased.

13. State & Local Restrictions
The following restrictions apply in certain states and localities. This list is provided as a general guide and is not exhaustive. You are solely responsible for knowing and complying with the laws of your jurisdiction.

California

  • Certain semi-automatic rifles and “assault weapons” prohibited.
  • Magazine capacity limited to 10 rounds.
  • Ammunition sales require shipment through a licensed vendor in California.

Colorado

  • Magazine capacity limited to 15 rounds.

Connecticut

  • Requires valid state-issued permit or eligibility certificate for firearm and ammunition purchases.
  • Certain semi-automatic firearms restricted.
  • Magazine capacity limited to 10 rounds.

Hawaii

  • Pistol magazines limited to 10 rounds.
  • Ammunition cannot be shipped directly to consumers.

Illinois

  • Requires valid FOID (Firearm Owner’s Identification) card for firearm and ammunition purchases.
  • Cook County (including Chicago) imposes additional restrictions.

Maryland

  • Magazine capacity limited to 10 rounds.
  • Certain “assault weapons” restricted.

Massachusetts

  • Firearms and magazines subject to strict approval lists.
  • Ammunition requires state-issued permit.

New Jersey

  • Magazine capacity limited to 10 rounds.
  • Hollow-point ammunition restricted.
  • All firearm transfers subject to state licensing requirements.

New York

  • Magazine capacity limited to 10 rounds.
  • Certain semi-automatic rifles and other firearms restricted under the NY SAFE Act.
  • Ammunition sales must go through a licensed New York dealer.

Washington, D.C.

  • Firearms and ammunition shipments prohibited.

Other Restrictions

  • Alaska & Hawaii: No ammunition shipments.
  • Puerto Rico, Guam, U.S. Virgin Islands, American Samoa: Firearms and ammunition shipments restricted or prohibited.
  • Local Ordinances: Additional restrictions may apply in cities or counties (e.g., Denver, Boulder, Los Angeles, Chicago).

Customer Responsibility

  • This list is provided as a courtesy and may not reflect the most recent legal changes.
  • By purchasing from Hot Metal Transfers, LLC, you agree that you are solely responsible for understanding and complying with all federal, state, and local laws governing firearms, ammunition, and accessories.
  • We are not responsible for orders denied, cancelled, or confiscated due to violations of applicable laws.
  • Any order placed in violation of these laws will be cancelled, and restocking fees may apply.

14. In-Person Transfers

Federal and Pennsylvania laws do not allow us to transfer any firearms in-person without the completion of a background check.

If you have had a firearm shipped to us and are DENIED for any reason, we will not transfer the firearm to anyone locally.  Your options are:

  1. Appeal the denial through the Pennsylvania State Police. We will store the firearm for up to 100 days – you have 30 days to file your appeal and the Pennsylvania State Police then have 60 days to provide you with a final decision – before you must choose another option below (unless your appeal is granted, in which case we are happy to process the transfer to you).
  2. Return the firearm to the seller (you pay the return shipping).
  3. Sell the firearm through us on consignment (20% commission plus shipping and listing costs).
  4. Sell the firearm online yourself, but it must be shipped to another FFL (you pay shipping) – NO LOCAL SALES.

If you are unable to receive a firearm, you need to pick one of the other options.  We will NOT buy the gun from you and storage of a firearm past 100 days or after a denied appeal will be charged a storage fee of $5 PER DAY.

15. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable federal law.
  • Any disputes shall be resolved in the state or federal courts located in Allegheny County, Pennsylvania.

16. Changes to Terms.  We reserve the right to update or modify these Terms & Conditions at any time. Changes will be posted on this page with a new “Last Updated” date.
